1. ACCEPTANCE AND SCOPE

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Gachamacha ("Company," "we," "us," or "our") governing your access to and use of the Gachamacha website and services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and all incorporated policies, including our Privacy Policy.

If you do not agree to these Terms, you are prohibited from using the Service.

2. ELIGIBILITY AND ACCOUNT REQUIREMENTS

2.1 Age Requirement

You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You agree to immediately notify us of any unauthorized access or security breach.

2.3 Accurate Information

You must provide accurate, current, and complete information during registration and maintain the accuracy of such information throughout your use of the Service.

3. SERVICE DESCRIPTION AND AVAILABILITY

3.1 Digital Services & Delivery Timeframe

All our products are digital and will be delivered to the buyer within 24 hours of purchase. The buyer must verify receipt within 48 hours of delivery to ensure account access. Delivery methods vary by account type:

1. Pre-Linked Email Accounts
For accounts already linked to an email, login credentials will be sent to the buyer’s provided email address.

  • Delivery Timeframe: Within 24 hours of purchase.
  • Verification Window: Buyer must confirm receipt or report issues within 48 hours of delivery.

Troubleshooting:

  • Check Inbox, Spam, Junk, or All Mail folders.
  • If undelivered, contact support immediately (common issues: incorrect email, full inbox).

2. Guest/Device-Linked Accounts
For accounts tied to a device (guest accounts), we facilitate the transfer process by linking the account to the buyer's provided email. This requires real-time coordination - buyers must be available for immediate verification during the linking process.

Process Requirements:

  • Buyer must initiate contact via Website Live Chat immediately after purchase
  • Provide valid Order ID for verification
  • Be prepared to complete the binding process in one session (typically 15-30 minutes)

Timing:

  • Service Window: Linking completed within 24 hours of purchase initiation
  • Verification Period: Buyer must confirm successful binding within 48 hours of delivery

Important Notes:

  • Delayed communication may extend the processing timeline
  • We cannot guarantee same-day service for requests made outside business hours (GMT+8)
  • Multiple missed connection attempts may require repurchasing the service

3.2 Intermediary Role

Gachamacha acts as a broker and does not create, manufacture, or license the accounts sold. We facilitate transactions between buyers and sellers and take a commission for this service. We are not affiliated with game developers and do not guarantee compliance with their Terms of Service.

3.3 No After-Sales Support for In-Game Related Cases

We do not provide support for in-game issues, including but not limited to:

  • Guidance on game setup, login issues, or account binding
  • Technical support for in-game questions (e.g., farming materials, obtaining characters)
  • Assistance with developer-side bans or restrictions

Buyers must fully understand how the product works before purchasing.

3.4 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.

3.5 Digital Goods Acknowledgment

You acknowledge that digital accounts are delivered within 24 hours and cannot be "returned" or "refunded" once payment is made, except as expressly provided in our Refund Policy. All sales are final unless otherwise stated in the Refund Policy.

4. PURCHASES AND PAYMENT

4.1 Refund Policy Summary

Refunds are only granted under specific conditions as outlined in our Refund Policy. By purchasing, you agree to the terms stated therein.

4.2 Payment Terms

1. Immediate Payment Requirement

  • Card Payments: Full payment is required at checkout. Orders will not be processed without successful payment confirmation.
  • PayPal/Wise Payments: Full payment must be completed manually via Live Chat or Discord before order processing begins.

2. Currencies

  • All prices are displayed in USD (US Dollars).

3. Valid Payment Methods

  • Debit/Credit Cards (via Stripe):
    • Includes Visa, Mastercard, American Express, JCB, and Discover.
    • Must support 3D Secure (3DS) authentication for security.
  • PayPal & Wise:
    • Processed exclusively through Website Chat or Discord.
    • We reserve the right to decline high-risk transactions (e.g., suspicious activity, chargeback history), or block users suspected of fraudulent intent.

4. Payment Security

  • Card payments require 3D Secure (3DS) authentication.
  • If your card does not support 3DS, please use an alternative payment method.

5. Payment Failure Consequences

  • Unpaid orders will be automatically canceled.
  • Repeated payment failures may result in account suspension or ID verification requirements.

6. Dispute Resolution

  • For payment issues, contact your payment provider first.
  • If payment succeeds but delivery fails, email us within 24 hours with your Order ID for resolution.

7. Payment Provider Dispute Waiver

  • By completing a purchase, you agree to resolve any issues directly with us first before filing a dispute with your payment provider.

4.3 Chargeback Policy

Buyer Acknowledgment:

You confirm that:

  • You are the rightful owner of the payment method used.
  • You will not file false chargebacks for:
    • "Item not received" (if delivery was confirmed).
    • "Unauthorized transaction" (if you made the purchase).
    • "Product not as described" (if it matched the listing).

Unauthorized Chargebacks Are Fraud

Chargebacks filed without prior communication will be treated as "cyber shoplifting" (fraudulent activity).

Consequences of False Chargebacks:

Intentional abuse may result in:

  • User data shared with:
    • National ombudsmen/financial bureaus.
    • Industry platforms (EpicNPC, ZeusX, Playswap, g2g, etc.) for blacklisting.
  • 14-30 working days to resolve disputes.

4.4 Re-Delivery Fee

If you lose your account details, a $15 re-delivery fee applies (subject to verification of ownership).

4.5 Taxes

You are responsible for all applicable taxes, duties, and fees related to your purchases. We reserve the right to retroactively charge taxes if legally required.

5. PROHIBITED CONDUCT

You agree not to:

  • Violate any applicable laws or regulations.
  • Provide false or misleading information.
  • Impersonate any person or entity.
  • Resell, redistribute, or commercialize purchased products.
  • Use automated systems to access the Service.
  • Attempt to circumvent security measures or gain unauthorized access.
  • Introduce malicious code or attempt to disrupt Service functionality.
  • Infringe upon intellectual property rights.
  • Engage in any conduct that may harm the Company or other users.

You acknowledge that:

  • Account trading violates most game developers' Terms of Service and assume all risks.

6. INTELLECTUAL PROPERTY

6.1 Ownership

The Service and all content, features, and functionality are the exclusive property of Gachamacha and protected by intellectual property laws. No license, express or implied, is granted to users to use, reproduce, or exploit any part of the Service without our prior written consent.

6.2 Third-Party Rights

Third-party trademarks, logos, and content displayed on the Service are used solely for descriptive purposes to identify products and remain the property of their respective owners. Our use does not imply endorsement or affiliation.

6.3 User Content

Any feedback, reviews, or content you submit becomes our property and may be used for any purpose without compensation to you.

7. DISCLAIMERS AND WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

You acknowledge that account trading is against most game developers' policies, and Gachamacha is not responsible for bans or restrictions imposed by them. Any bugs or glitches in purchased accounts must be resolved with the game developer; we provide no support for such issues.

8. LIMITATION OF LIABILITY

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that you have read and understand our Privacy Policy.

In cases of chargebacks or fraud, we may share user data with third-party platforms, financial authorities, or national bureaus for security purposes.

11. TERMINATION

11.1 Termination Rights

We may suspend or terminate your access to the Service immediately and without notice for any violation of these Terms or for any other reason at our sole discretion.

11.2 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination shall remain in effect, including ownership rights, warranty disclaimers, indemnity obligations, and limitations of liability.

12. DISPUTE RESOLUTION

12.1 Governing Law

You hereby agree that the laws of Malaysia shall govern this Terms and that the courts of Malaysia shall have non-exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

12.2 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of Asian International Arbitration Centre. You waive your right to participate in class action proceedings.

12.3 Injunctive Relief

Nothing herein shall prevent us from seeking injunctive or other equitable relief for violations involving intellectual property or confidential information.

13. FORCE MAJEURE

We shall not be liable for any failure to perform our obligations due to unforeseeable circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or acts of God.
  • Government actions, war, terrorism, or civil unrest.
  • Strikes, labor disputes, or supply chain disruptions.
  • Technical failures, data breaches, cyberattacks, or unauthorized access to systems.
  • Any other event that renders performance commercially impracticable.

14. MODIFICATIONS

We reserve the right to modify these Terms at any time. Material changes will be effective thirty (30) days after notice is provided via email or website posting. Your continued use of the Service after such notice constitutes acceptance of the modified Terms.

15. GENERAL PROVISIONS

15.1 Entire Agreement

These Terms, together with our Privacy Policy and other incorporated policies, constitute the entire agreement between you and the Company.

15.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

15.4 Waiver

Our failure to enforce any provision does not constitute a waiver of such provision or any other provision.
